The National Coal Limited (NCL) has claimed that it is not responsible for the illegal coal storage near Krishansila Railway Siding in Sonbhadra. The NCL has also stated that it has no role in this storage and has not been given any permission for it. The land in question was transferred to the Railways by the NCL for usage years ago. The NCL has based its claims on the fact that the Railways had requested the Ministry of Energy, Coal Department, to lease 105.81 acres of land on October 24, 1988. This land was given to the Railways for the construction of the Karaila Road-Bina-Jayant branch. The 35-bigha area where the illegal coal storage is located falls under the Bina line. The Krishansila Railway Siding is a well-maintained railway siding under the operational control/physical possession of the East Central Railway. The siding is used for transporting coal by various coal consumers. The NCL has stated in the report that the 35-bigha land is under the actual physical possession of the Railways and is used by the Railways for storage/transportation. The NCL has no right to store/transport coal to customers/buyers. The NCL's responsibility ends when the seller/buyer's loaded trucks pass through Clause Four (Mine Barrier/Checkpoint) at the Krishansila Railway Goodshed Siding. The NGT had previously ordered the NCL to deposit 10 crore rupees as environmental compensation and had also issued guidelines for remedial measures. The NCL had filed a review petition with the NGT, which was rejected.
